Terms of Service

1. Agreement

By creating an account, downloading, installing, or using Clarity (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Clarity is a desktop AI overlay and related cloud services that can capture screen content you choose to analyze and return AI-generated responses. Features differ by plan (Visible vs Undetectable).

3. Your responsibility — critical

You are solely responsible for how you use Clarity. TerraByte Solutions LLC is not responsible for your conduct or for any consequences of your use of the Service. You alone must ensure that your use complies with:

• employer, school, and organizational policies;
• exam, interview, proctoring, and assessment rules;
• platform, meeting, and third-party terms of service;
• all applicable local, state, and national laws.

We do not monitor or control end-user sessions. We do not accept liability for misuse.

4. No warranty of "undetectability"

The Undetectable plan is designed to reduce the overlay’s appearance in screenshots, recordings, and some screen-share pipelines. We do not warrant that Clarity will be invisible to all software, administrators, process lists, humans, or future detection methods. Technical implementation details are proprietary and not a public specification.

5. AI output

Model outputs may be incomplete, incorrect, or inappropriate. You must verify answers before relying on them. Clarity is not professional legal, medical, financial, or academic advice.

6. Screenshots and data

When you trigger analysis, screen content may be transmitted to our servers and to third-party AI providers. Do not capture content you are not authorized to process. See our Privacy Policy and the list of subprocessors we use.

7. Subscriptions, trial, and billing

Paid plans are billed monthly (Visible: $20; Undetectable: $99.99) unless otherwise stated at checkout. We may offer a 3-day free trial of Visible only, which requires a valid payment method at signup. You will not be charged for the trial period if you cancel before it ends; afterward, the Visible subscription price applies unless you cancel. Trial usage may be rate-limited (including a daily analysis cap). The Undetectable plan is not available as a free trial. Fees are non-refundable except where required by law. We may change prices with notice for subsequent billing periods. Failure to pay may suspend access. One trial per customer may be enforced.

8. Acceptable use of infrastructure

You may not reverse engineer the Service for the purpose of stealing keys, attack our systems, exceed rate limits by abuse, or resell access without written permission. We may suspend accounts that harm infrastructure or other customers.

9. As-is; limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERRABYTE SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE — INCLUDING ANY DISCIPLINARY, ACADEMIC, EMPLOYMENT, OR LEGAL CONSEQUENCES OF YOUR USE.

10. Indemnity

You agree to indemnify and hold harmless TerraByte Solutions LLC and its officers from claims arising out of your use of Clarity or your violation of these Terms.

11. Changes

We may update these Terms. Continued use after changes constitutes acceptance of the revised Terms.
